These Terms & Conditions (“Terms”) constitute a legal agreement between you ("Client", "you", or "your") and All Solutions Consulting LLC, an Oklahoma entity doing business as Lift My Spa ("we", "us", or "our"). By purchasing or subscribing to any service or product provided by Lift My Spa, you agree to be bound by the following Terms, which govern your use of our software, marketing services, automation tools, and related offerings.
1. Scope of Services
Lift My Spa provides non-clinical marketing, automation, lead generation, and AI-powered communication tools tailored for licensed medical spas operating in the United States. Our services may include:
Marketing automation systems (email/SMS workflows)
AI-based chat and call tools
Ad campaign management (Google, Meta, etc.)
CRM setup and reporting dashboards
Referral and review automation tools
Landing pages, content generation, and SEO
We do not provide medical advice, diagnosis, or clinical treatment. All medical procedures promoted through your business must be offered under proper state licensure and medical supervision.
2. Compliance Responsibility
You are solely responsible for ensuring that your use of Lift My Spa services complies with:
Federal laws including HIPAA, FTC advertising rules, CAN-SPAM, TCPA, and anti-kickback statutes
State regulations including those set by state medical boards.
Any other applicable laws governing the promotion of medical services
We provide tools and templates designed with compliance in mind. However, all content and campaign materials must be reviewed, adapted, and approved by you before use. Lift My Spa is not responsible for any legal or regulatory issues resulting from unmodified use of our templates or automation flows.
3. HIPAA Notice
Lift My Spa uses HIPAA-compliant systems and offers data handling tools with encryption, audit logs, and access controls. However, HIPAA compliance depends on proper use by your organization, including signing any required Business Associate Agreements (BAAs) with platform vendors (e.g., CRM or SMS providers).
4. Results & Performance Disclaimer
While many clients have seen improvements in bookings, referrals, or lead generation, individual results may vary based on market, offer, spend, and team responsiveness.
Statements such as “5X more leads,” “30% more referrals,” or “60% more 5-star reviews” are based on client-reported outcomes and do not constitute guaranteed results.
5. Subscription, Billing & Cancellation
Most services are billed monthly unless otherwise agreed in writing.
No long-term contracts are required unless specified in a custom agreement.
Cancel any time with 7 days’ notice before the next billing cycle.
To cancel your subscription, email us at [email protected] with the subject line “Cancel Lift My Spa Subscription”. Please include the account owner's email, company name, and desired cancellation date.
Setup fees (if applicable) are non-refundable once work has begun.
Upon receiving your initial subscription payment, please allow 24 to 72 hours for account creation and delivery of login credentials.
6. Add-Ons (Usage-Based Fees):
Making Calls: $0.0168 per minute
Receiving Calls: $0.0102 per minute
Text Messages: $0.01 per segment
Email Sending: $0.0008 per email
Reviews AI: $0.096 per review response
Domain Purchase: $12 per domain
WhatsApp Usage: $0.0888 per session
Any additional add-ons or integrations may be quoted and billed separately.
7. Intellectual Property
All materials created by Lift My Spa — including automations, landing pages, templates, and AI configurations — remain our intellectual property unless otherwise transferred via written agreement.
You are granted a non-exclusive, non-transferable license to use these assets during your active subscription.
8. Client Responsibilities
You agree to:
Provide accurate, lawful information for use in all marketing efforts.
Ensure that your website, booking tools, and staff follow local advertising and clinical standards.
Not use Lift My Spa tools to promote illegal or unlicensed services.
9. Limitations of Liability
To the fullest extent permitted by law, Lift My Spa shall not be liable for:
Loss of revenue, clients, or reputation
Fines or regulatory actions from your failure to comply with local laws
Third-party software malfunctions or data loss beyond our control
Total liability for any claim is limited to the amount paid by you in the prior 30 days.
10. Changes to Terms
We may update these Terms at any time. Continued use after changes are posted constitutes acceptance. Clients will be notified of material changes via email or in-app message.
11. Templates, Content & Legal Responsibility
Lift My Spa provides templates, scripts, automation flows, and content suggestions (“Templates”) as a convenience. These are:

Not tailored to your specific business, services, or jurisdiction
You are solely responsible for ensuring all marketing content complies with HIPAA, FTC rules, state medical board regulations, and patient inducement laws.
We strongly recommend all content be reviewed by your legal counsel or compliance advisor before publishing.
Lift My Spa disclaims liability for regulatory actions, fines, or reputational damage resulting from use of unreviewed templates.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Oklahoma, without regard to conflict of law provisions.
